Titolo: Attuale valenza del principio di tassatività degli atti impugnabili anche alla luce della nozione di atto facoltativamente impugnabile
Abstract: La presente trattazione ha come fine quello di esaminare le problematiche concernenti gli atti impugnabili dinnanzi ai giudici tributari, di cui all'art. 19 del D. Lgs. n. 546/92. L'elencazione contenuta in tale articolo valeva a connotare il processo tributario come un processo di impugnazione, in cui, e' soltanto la notifica di uno degli atti tipicamente individuati faceva sorgere l'interesse al ricorso del contribuente. Sennonche', l'elencazione degli atti suscettibili di impugnazione e' stata da sempre oggetto di dibattito dottrinale e di pronunce giurisprudenziali. Dottrina e giurisprudenza, difatti, hanno ritenuto non tassativa l'enumerazione di tali atti per soddisfare esigenze di tutela del contribuente, soprattutto a seguito dell'ampliamento della giurisdizione tributaria anche per effetto dell'evoluzione della normativa tributaria sostanziale. In particolare, con le pronunce dei giudici di Piazza Cavour, che si sono susseguite negli ultimi anni, sembrerebbe essere venuta meno gran parte della valenza che da sempre aveva contraddistinto l'art. 19. Prima di addentrarmi nelle problematiche sollevate dall'art. 19, vuoi in relazione agli atti impugnabili dinnanzi le Commissioni Tributarie, vuoi relativamente alla nascita del principio di tassativita' ad opera dell'art. 1 del D.P.R. n. 636/72, e' sembrato opportuno passare in rassegna l'art. 2 del D.Lgs. n. 546/92 che disciplina la giurisdizione in materia tributaria, nonche' le modifiche apportate allo stesso articolo - prima ad opera della L. n. 448 del 2001 (Legge Finanziaria per il 2002) e, successivamente, con il D.L. n. 203 del 2005, convertito con modifiche dalla Legge n. 248/2005 - che hanno esteso la giurisdizione delle Commissioni Tributarie ai tributi di ogni genere e specie, comunque denominati. Tale estensione, giocoforza, ha avuto il suo riflesso sulla problematica oggetto della presente ricerca. Il lavoro procede poi ad illustrare, e brevemente commentare, le pronunce della Suprema Corte di Cassazione che sono intervenute in tema di atti impugnabili. Esaminando le sentenze si avra' modo di notare come l'orientamento giurisprudenziale sia oscillato dal negare la possibilita' di impugnare atti non elencati, al concedere tale possibilita' ricorrendo alcune condizioni, financo a dichiarare inammissibile un ricorso avverso un atto tipicamente elencato (o ricorribile soltanto per vizi propri) allorquando sia stato preceduto da un atto atipico non impugnato. Un'apposita parte della trattazione mette, poi, in evidenza il problema della tipicita' dell'elencazione dell'art. 19, che ha tanto impegnato la dottrina negli ultimi anni. Il dibattito vede contrapposti sia chi ritiene ormai superata la tassativita' dell'elencazione di cui al sopra citato articolo, sia chi la considera ancora valida ma insiste sulla possibilita' di poter impugnare anche altri atti che, per contenuto e forma, sono assimilabili a quelli tipicamente elencati. Un capitolo e' dedicato alla disamina degli atti ai quali e' stato consentito l'accesso alla giurisdizione tributaria, seppur non elencati nell'art. 19 e alle problematiche ad essi legate, quale quella relativa alla necessita' di una rituale notifica degli stessi o di una semplice comunicazione. Dalle ricerche svolte sono emersi una serie di dubbi interpretativi di non poco conto, soprattutto legati alle pronunce della Suprema Corte di Cassazione in cui si affronta il tema della impugnazione (necessaria o facoltativa) di atti non elencati in relazione alla cristallizzazione o meno degli effetti e della pretesa in essi riportata. Infine, si e' rilevato che dalla disamina della giurisprudenza susseguitasi negli ultimi cinque anni, si e' constatato che il discrimine affinche' ritenere impugnabile un atto non sembra essere piu' l'inserimento nominativo dello stesso fra quelli elencati nell'art. 19, D. Lgs. n. 546/92, quanto, piuttosto, l'esaurimento del procedimento impositivo, cioe' una pretesa non in itinere, ma definita in tutti i suoi elementi che sia portata a conoscenza con l'atto fiscale, si' da far nascere, fin da subito in capo al soggetto passivo, l'interesse ad agire ex art. 100 c.p.c..
This discussion has as its purpose to examine the problems concerning law challenged in the courts before tax, of which art. 19, D. Legislative Decree No. 546/92. The list in that article was worth to characterize the process as a tax appeal process, in which "only" a notification of an act typically identified raised the interest in the action of the taxpayer. Case, however, lists are likely to appeal has always been the subject of legal debate and case law. Doctrine and jurisprudence, in fact, have not considered exhaustive enumeration of such acts to satisfy the need to protect taxpayers, especially after enlargement of the fiscal court also due to the evolution of substantive tax law. In particular, the rulings of Piazza Cavour, which have followed in recent years appears to have failed most of the value that had always marked the art. 19. Before getting into the issues raised in the article. 19, either in relation to the acts open to challenge before the Tax Commission, either in relation to the birth of the principle of obligatory nature by art. 1 of Presidential Decree No 636/72, it seemed appropriate to review the art. 2 of Legislative Decree no. 546/92 governing the jurisdiction in tax matters, including amendments made to the same article - the first by L. No 448 of 2001 (Budget Law for 2002) and, subsequently, with the DL No 203 of 2005, ratified with amendments by Law No. 248/2005 - that extended the jurisdiction of the Tax Commission to taxes of every kind and species, however described. This extension, clear, had its reflection on the issues covered by this research. The work then proceeds to illustrate, and briefly comment on the rulings of the Supreme Court that have occurred in terms of acts to appeal. By examining the judgments will be able to see that the jurisprudence has swung from denying the possibility to challenge acts not listed, use that opportunity to give some conditions, even to declare inadmissible an appeal against an act typically listed (or appointed only for defects own) when it was preceded by an unusual act was not challenged. A special part of the deal puts it, then, highlighted the problem of typicality of the list article. 19, which has so committed to the doctrine in recent years. The debate saw both those who opposed the mandatory nature considers outdated list referred to above article, and those who still consider it valid, but insists on the possibility to challenge other acts which, in content and form, are similar to those typically listed . One chapter is devoted to the examination of the acts who have been allowed access to the fiscal court, although not listed in Art. 19 and the problems connected with them, such as that relating to the need for notification of the same ritual or a simple statement. Have emerged from research carried out a series of questions of interpretation are not negligible, especially related to the rulings of the Supreme Court which deals with the appeal (or voluntary) of documents not listed or not in relation to the crystallization of the effects and the claim in their report.
